TSCS: These TERMS AND CONDITIONS AND PRIVACY POLICY
Site: www.atelierkristel.com, the website hosted online displaying the work of Artist Kristel Bechara, they terms are used interchangeably and shall have the same meaning.
PURPOSE OF THE TSCS
The TSCS are intended to define the rules of use of the Site by the User, as well as the obligations of www.atelierkristel.com.
The User agrees, each time he/she visits to the Site, to respect the present TSCS applicable to all services and the contents available on the Site.
As a result, the User accepts, without any reservation, these TSCS in their entirety before any use of this Site and its services.
UPDATE OF THE TSCS
www.atelierkristel.com reserves the right to modify, at any time, the TSCS in order to factor in any legal, jurisprudential, editorial, functional and/or technical evolution required.
The version of the TSCS that shall prevail is the one that is accessible online via the Site on the day the Site is being used by the User and available at the address www.atelierkristel.com/tscs.
DESCRIPTION OF SERVICES
The Site offers Users a service allowing them to consult the catalogue of the various artworks offered for sale by the artist Kristel Bechara, as well as make offers to purchase artworks that are for sale.
The sales are made in application of the General Conditions of Sale available at the following address www.atelierkristel.com/gtcs the User must refer to before any purchase.
INTELLECTUAL PROPERTY
www.atelierkristel.com is the exclusive owner of all intellectual property rights on both the development of the Site and its content, unless expressly mentioned otherwise.
The Site, brands, drawings and models, images, texts, photos, logos, graphic charters, software and programmes, search engines, databases, sounds, videos, domain names, design and any other content available on the Site, although this list is not exhaustive, are the exclusive property of www.atelierkristel.com and are protected by the provisions of the copyright law, trademark laws, patent law and any other right of intellectual or industrial property in force.
The User must seek the prior approval of www.atelierkristel.com for any reproduction, publication, copy of the various contents from the Site.
Any full or partial reproduction, by any process whatsoever, of the content of the Site without the prior authorization from www.atelierkristel.com, would constitute an infringement under article under the corresponding applicable laws and jurisdiction of where the infringement occurred.
PERSONAL DATA
The personal data of the User are collected and kept by www.atelierkristel.com to allow the implementation of these provisions.
When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address and phone number. We’ll use this information for purposes, such as, to:

- Respond to your requests, including refunds and complaints
- Process payments and prevent fraud

These Cookies are designed to allow a faster and more effective user navigation for the User during his/her various connections on the Site.
The User may, if he so wishes, disable Cookies through the settings of the browser used to be able access the Site.
While you visit our site, we’ll track:
- Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
- Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping

DURATION
These TSCS enter into force from the time the User accesses the Site and without the need for him to create a user account or to log into the site. They apply as long as the User utilises the services of www.atelierkristel.com.
SITE’S LIABILITY
In its relationship with the User, www.atelierkristel.com shall not be held responsible for the interruption of operation of the site or inability to access it, or adverse conditions of usage of the Site OR any loss of data, time, opportunity and/or any other indirect damage related to the use of the Site.
ENTIRE CONTRACT
These TSCS constitute the entire terms and conditions agreed between www.atelierkristel.com and the User and replace any earlier agreement, written or oral, relating to the purpose of the TSCS.
All additional terms and conditions or dispute pertaining to the purpose of the TSCS and contained in any written or oral communication addressed to www.atelierkristel.com will be void and unenforceable.
DIVISIBILITY
If, for any reason and to any extent whatsoever a provision of these terms should be deemed as void or unenforceable, such invalidity or unenforceability shall not affect the validity and enforceability of the other provisions of these TSCS and the relevant stipulation shall be applied to the extent permitted by law.
COMPETENT JURISDICTION
In case of a dispute and if no amicable solution is found, express jurisdiction shall be attributed to the Courts of Dubai in the United Arab Emirates, notwithstanding the plurality of defendants or right of appeal, even for emergency or protective procedures, summary procedures or by request.
Payments
We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information. (Please see the PayPal Privacy Policy for more details).

GTCS: These GENERAL TERMS AND CONDITIONS OF SALE
Site: www.atelierkristel.com, the website hosted online displaying the work of Artist Kristel Bechara, they terms are used interchangeably and shall have the same meaning.
PURPOSE OF THE GTCS
The purpose of the www.atelierkristel.com website is to present Artworks from artist Kristel Bechara (hereinafter the “Artist”) to the users of the site (potential “Buyers”), and to give them the opportunity to discover and buy them online directly from the Artist.
These GTCS are meant to define the terms and conditions for the online sale of the Artworks available on the site, and to define each party’s rights and obligations in such a relationship.
ACCEPTANCE
The unconditional acceptance of the entire general conditions of sale is mandatory to conclude the sale agreement, by both the Artist and the Buyer. The acceptance is confirmed by a box that needs to be checked on the Artwork order form.
ORDER
The Artworks are offered for sale on the Artist’s website, subject to their availability.
Each of the Artwork offered comes with a short explanation sheet containing information about its substrate, its dimensions, its weight and type.
To order an Artwork, the Buyer must select the Artwork of his/her choice, place it in his/her cart and provide the necessary personal information to place the order (or identify him/herself, if he/she has a User account). Before validating the order, the Buyer must check the information appearing on the order summary, and he/she can correct any potential mistakes in the items inserted, as well as read about the delivery costs.
The Buyer will not be charged for the payment before his/her purchase offer has been validated, which is done within 48 hours by www.atelierkristel.com, in order to ensure the Artwork’s availability from the Artist.
If the Artwork is no longer available, an email informing the Buyer will be sent within 48 hours, cancelling the order.
SALES PRICES AND TERMS OF PAYMENT
The Artworks sale price is listed on the Site in the currency set by the Artist and includes all taxes, excepting delivery and packaging fees if applicable.
The different methods of delivery and related costs are shown in the order summary. The delivery and packaging costs depend on the type of artwork, its dimensions, its weight, as well as the place of delivery.
The payment of the artwork price by the Buyer to the Artist is made via the payment services available from www.atelierkristel.com : credit card or bank transfer (which terms of use available at: www.atelierkristel.com)
Transfer of ownership happens as soon as the full price has been paid by the Buyer. Failure to pay the full price automatically cancels the sale, and the artwork is put back for sale on www.atelierkristel.com.
DELIVERY OF THE ARTWORKS
The delivery of the Artworks is made at the address provided on the order summary form, during the business hours and according to the procedures laid down by the carrier chosen upon ordering.
The Buyer must inform him/herself about the procedures and delivery schedules implemented by the various delivery services providers.
Obligations regarding the delivery of the order, meaning respecting the given schedules, the quality of the packaging for the artwork, as well as the conformity of the later are the sole responsibility of the Buyer, www.atelierkristel.com’s shall in no case be held liable for failure to comply by the Buyer, who is entitled to lodge a complaint against the delivery service provider.
The Buyer must, as soon as he receives the order, check the condition of the artwork, and mention any reservation immediately and in writing, at the latest within 48 hours, to info@atelierkristel.com.
RIGHT OF RETURN
The Buyer has a period of 14 days from the delivery of the Artwork to use his/her right of return with the Artist, without any costs or reason if the artwork was not as described.
The Buyer may use his/here right of return with www.atelierkristel.com through sending an email to the following address info@atelierkristel.com.
www.atelierkristel.com will then be responsible for handling the cancellation from the Buyer and shall process the refund within 14 days following the date on which www.atelierkristel.com was informed about the Buyer exercising his/her right of return.
The refund applies to the price of the artwork but does not include the cost of shipping and packing paid by the Buyer, as well as the return shipping costs – such costs shall be deducted, and the balance refunded unless the artwork was not as described.
The returned artworks that are damaged or dirtied by the Buyer shall not be accepted, nor refunded, www.atelierkristel.com reserves the right to decide at its sole discretion.
